Terms of Use

1. Agreement

By downloading or using Math Pals (the "App"), you agree to these Terms of Use. If you are a parent or guardian allowing a child to use the App, you accept these terms on their behalf. If you do not agree, please do not use the App.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, for personal, non-commercial use, in accordance with these terms and Apple's Media Services Terms and Conditions. This license is also governed by Apple's standard Licensed Application End User License Agreement (EULA), available at apple.com/legal.

3. In-app purchases

The App offers optional in-app purchases of "Gems," a virtual currency usable only for cosmetic items within the App. Gems and cosmetic items: (a) have no real-world monetary value; (b) cannot be exchanged, refunded, or transferred outside the App except as required by law or Apple's policies; (c) never affect learning content or gameplay progression, which remain free. All purchases are processed by Apple and are subject to Apple's payment terms. Purchases in the App are placed behind a parental gate; parents are responsible for supervising purchases and may use Apple's Ask to Buy and Screen Time features for additional control.

4. Virtual items

Creatures, currencies, and other virtual items in the App are licensed to you, not sold, and exist only within the App. We may adjust game balance, content, and features over time to keep the App fun, fair, and functioning.

5. Acceptable use

You agree not to copy, modify, reverse-engineer, resell, or exploit the App or its content except as permitted by law, and not to use the App in any way that violates applicable laws or these terms.

6. Intellectual property

The App, including its code, artwork, characters, names, and design, is owned by us and protected by intellectual property laws. These terms grant you no ownership rights in the App or its content.

7. Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. While Math Pals is designed to support learning, we make no guarantees regarding educational outcomes.

8. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of the App. Our total liability for any claim shall not exceed the amount you paid for the App and its in-app purchases in the twelve months preceding the claim.

9. Apple's role

These terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the App and is not responsible for addressing claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.

10. Changes and termination

We may update these terms from time to time; continued use of the App after changes constitutes acceptance. We may discontinue the App or any feature at any time.

11. Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles.
